These Terms and Conditions (the “Terms”) govern your access to and use of the website https://photographybyiela.com (the “Site”) and, where applicable, the request, booking, purchase, and delivery of photography, videography, visual production, and related services provided by Photography by Iela LLC, operating under the trade name Photography by iela LLC (the “Services”).

Photography by iela LLC is a visual brand focused on direction, intention, and editorial aesthetics, offering photography and video services for weddings, editorial sessions, brands, artists, families, and other visual projects. The company is based in Florida and may be available for international projects.

By accessing, browsing, submitting forms, requesting information, booking a session, hiring services, or using the Site in any way, you agree to these Terms. If you do not agree with them, you must refrain from using the Site or requesting our Services.

The purpose of the Site is to provide general information about Photography by Iela LLC and its brand Photography by iela LLC , showcase its portfolio, describe its services, receive contact requests, and facilitate communication with current or potential clients.

Photography by Iela LLC may offer photography, videography, creative direction, visual production, editorial sessions, wedding coverage, engagement sessions, maternity sessions, business photography, artist content, event coverage, nightlife, fashion/editorial, gender reveal, and other visual services, depending on availability, proposal, and client needs.

The features, pricing, deliverables, dates, delivery times, number of images, editing, coverage duration, usage rights, and specific conditions for each Service will be those stated in the applicable proposal, invoice, contract, written confirmation, or communication.

If there is any inconsistency between the general information published on the Site and a proposal, invoice, or contract accepted by the client, the terms of the specific accepted document will control.

4. Forms, requests, and communications

By submitting a form, request, message, or communication through the Site, you represent that the information provided is true, complete, and up to date.

Submitting a request or form does not guarantee availability, automatic booking, acceptance of the project, or delivery of the Service. Photography by Iela LLC may respond, accept, decline, or request additional information as appropriate.

The Site may request that users provide details such as date, location, project type, and references in order to prepare a proposal aligned with their needs.

5. Bookings, payments, and commercial terms

A booking will be considered confirmed only when Photography by Iela LLC confirms it in writing and, where applicable, the client has paid the required initial payment, deposit, or retainer.

Prices, deposits, payment methods, due dates, deliverables, and commercial terms will be those stated in the applicable proposal, invoice, contract, or confirmation.

Unless otherwise agreed in writing, payments made for services already rendered, work already started, confirmed bookings, deposits, or costs already incurred may be non-refundable.

Photography by Iela LLC may suspend or cancel the delivery of Services in the event of non-payment, declined payments, incomplete information, client delays, or breach of these Terms.

6. Changes, cancellations, and rescheduling

Any request to change the date, time, location, scope of service, deliverables, or type of session must be made in writing and will be subject to availability.

Cancellations or rescheduling may be subject to fees, loss of deposits, or price adjustments, as stated in the applicable proposal, invoice, contract, or confirmation.

If the client does not appear for a confirmed session or event, arrives late, or fails to provide the necessary conditions for the Service to be performed, Photography by Iela LLC may consider the Service started or forfeited, with no obligation to issue a refund unless otherwise agreed in writing.

7. Client responsibilities

The client agrees to:

1. Provide clear and complete information about the project, date, location, desired style, references, schedules, and special needs.

2. Obtain permits, access, venue authorizations, photography/video permissions, or any other authorization required to perform the session or coverage.

3. Arrive on time and provide reasonable conditions for the Service to be performed.

4. Inform Photography by Iela LLC in advance of any venue restrictions, schedule changes, venue rules, technical limitations, or special conditions.

5. Review and approve in a timely manner any material, proposal, or request that requires confirmation.

Delays, changes, or lack of information from the client may affect the result, delivery, or scope of the Service.

8. Delivery of materials

Delivery timelines for photographs, videos, galleries, clips, edited files, or any final materials will be those stated in the applicable proposal, invoice, contract, or written confirmation.

Unless otherwise stated, files will be delivered digitally through the method indicated by Photography by Iela LLC.

Delivery may vary depending on project volume, season, editing complexity, revisions, platform availability, and any reasonable circumstance outside the control of Photography by Iela LLC..

9. Editing, creative style, and revisions

The client acknowledges that photography, videography, editing, color, creative direction, composition, and overall visual style are part of the artistic and professional judgment of Photography by Iela LLC.

Requests for additional editing, advanced retouching, style changes, rush delivery, RAW files, unedited material, or revisions outside the original scope may result in additional fees, unless the proposal states otherwise.

10. Intellectual property and use of content

All Site content, including text, images, photographs, videos, graphics, logos, designs, materials, visual style, trade names, and other elements, belongs to Photography by Iela LLC or its licensors, unless otherwise stated.

Copying, reproducing, distributing, modifying, publishing, selling, or exploiting Site content without prior written authorization is prohibited.

Unless otherwise agreed in writing, Photography by Iela LLC retains the copyright to all photographs, videos, and materials created, and the client receives a license to use them as stated in the applicable proposal or contract.

Photography by Iela LLC may use photographs, videos, or materials created for portfolio, social media, website, commercial presentations, advertising, or promotional purposes, unless there is a written confidentiality agreement or restriction.

11. Client use of delivered materials

The client may use the delivered materials for the agreed purposes, such as personal use, social media posting, brand promotion, printing, or commercial use, depending on the type of project contracted.

The client may not sell, sublicense, substantially edit, alter authorship, apply filters that distort the final work, use the materials for illegal purposes, or transfer them to third parties for commercial exploitation without prior written authorization, unless the contract states otherwise.

12. Third-party links and services

The Site may include links, tools, or integrations from third parties, such as galleries, forms, booking systems, payment processors, social media platforms, or other external services.

Photography by Iela LLC does not control and is not responsible for the content, operation, availability, terms, or practices of such third parties.

13. SMS/Text Messaging Program
